Privacy Policy

Many of our customers use the Service to store and manage information about their own contacts, leads, employees, and financial records (“Customer Data”). Where our business customers (“Customers”) upload or submit Customer Data that includes personal information about their own employees, customers, or other third parties, we process that data on the Customer’s behalf and at the Customer’s direction, generally acting as a service provider or processor rather than as the party that decides how and why that data is used.

This Privacy Policy primarily describes our practices with respect to (a) Site visitors, and (b) Account Holders’ own account and billing information. If you are an individual whose personal information has been submitted to the Service by one of our Customers (for example, your employer uses Workyla HRM, or a business you interacted with uses Workyla CRM), please direct privacy inquiries to that organization in the first instance, as they control how your information is used; where required by law, we will also assist in responding to your request as their service provider.

We collect “Non-Personal Information” and “Personal Information.”

• Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information, referring/exit pages and URLs, browser and device type, and aggregate click and page-view data.
• Personal Information includes information that identifies or can reasonably be linked to you, such as your name, email address, phone number, business name, job title, billing and payment details, and any project details, messages, or files you provide.

2.1 Information Collected via Technology

You do not need to register for an account to browse the Site. However, to help us understand how visitors use the Site and Service and to improve them, we and our service providers use cookies and similar tracking technologies, including Google Analytics, to collect information such as the website you came from (the “referring URL”), the pages you view, the type of browser and device you use, the time and date of access, approximate location, and other information that does not by itself personally identify you. Company may use both persistent and session cookies; persistent cookies remain on your device after you close your browser until you delete them, while session cookies expire when you close your browser. We may also use conversion or advertising pixels from third-party platforms to help us understand which marketing efforts are effective.

2.2 Information You Provide Directly

We collect Personal Information that you provide directly, including when you:

• Register for an Account, start a free trial, or purchase a subscription (name, email address, phone number, company name, password, and billing/payment information);
• Invite Authorized Users to your Account, or are invited by an Account Holder to use the Service;
• Contact us through a form on the Site, request a demo, or email us directly (name, email address, phone number, and details about your inquiry);
• Apply for a job, subscribe to our blog or updates, or otherwise interact with the Site or Service.

By submitting this information, you authorize us to collect, store, and use it in accordance with this Privacy Policy in order to create and administer your Account, respond to you, and provide the Service.

2.3 Customer Data You Submit to the Service

When you use the Service as an Account Holder, you and your Authorized Users may submit Customer Data, which can include personal information about your own contacts, leads, customers, job applicants, and employees (such as names, contact details, employment and compensation records, communications, and financial or billing records). We process Customer Data as described under “A Note on Customer Data” above, in accordance with your instructions and this Privacy Policy, and, where applicable, a separate data processing agreement between us and the Customer.

2.4 Payment Information

If you purchase a paid subscription, payment card and billing details are collected and processed by our third-party payment processor(s). We do not store full payment card numbers on our own servers. We receive limited information from our payment processor, such as billing name, address, and the last four digits of your payment card, to manage your subscription and provide support.

2.5 Information from Third-Party Integrations

If you choose to connect the Service to a third-party application (such as an accounting, banking, communication, or CRM tool), we may receive information from that third party as necessary to provide the integration, in accordance with the permissions you grant. That third party’s own privacy policy governs its collection and use of your information.

2.6 Children’s Privacy

The Site and Service are directed at businesses and are not directed to anyone under the age of 16. We do not knowingly collect or solicit information from anyone under the age of 16. If we learn that we have gathered Personal Information from anyone under the age of 16 without appropriate consent, we will delete that information as soon as possible. Personal Information

Except as otherwise stated in this Privacy Policy, we do not sell, trade, or rent your Personal Information to third parties for their own marketing purposes without your consent. We use Personal Information to:

• Create and administer your Account and provide the Service, including the features of your selected subscription plan;
• Process payments and manage billing;
• Respond to your inquiries, prepare quotes, and provide customer support;
• Send administrative information, service updates, security alerts, and, where you have consented or as otherwise permitted by law, marketing communications;
• Monitor and analyze usage and trends to improve the Site and Service;
• Detect, investigate, and prevent fraudulent transactions and other illegal activities, and protect the rights and property of Company and others;
• Comply with our legal obligations.

We may share Personal Information with:

• Vendors and service providers (sometimes called “sub-processors”) who perform services on our behalf, such as cloud hosting, email delivery, customer support, analytics, and payment processing, solely for the purpose of enabling those services and subject to appropriate confidentiality and data protection obligations;
• Third-party integrations you choose to enable, to the extent necessary to provide that integration;
• A successor entity in connection with a merger, acquisition, financing, or sale of some or all of our assets, as described below; and
• Outside parties if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce our Terms of Service, including investigation of potential violations; to address fraud, security, or technical concerns; or to protect against harm to the rights, property, or safety of the Company, our users, or the public, as required or permitted by law.

Non-Personal Information

We use Non-Personal Information, including data collected through analytics tools, to help us understand how visitors use the Site and Service, improve them, and evaluate the effectiveness of our marketing. This Privacy Policy does not limit our use or disclosure of Non-Personal Information, and we reserve the right to use and disclose such information to our service providers and partners at our discretion.

Business Transfers

If we undergo a business transaction such as a merger, acquisition, or sale of some or all of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change materially, we will post the updated policy to the Site.

We are headquartered in the United States, and information we collect is processed in the United States and may be transferred to, stored, and processed in other countries where we or our service providers operate. Where required by applicable law, we take steps intended to provide an adequate level of protection for such transfers, such as relying on standard contractual clauses or equivalent safeguards.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your Personal Information based on one or more of the following legal grounds: (a) your consent; (b) performance of a contract with you (for example, to provide the Service you have subscribed to); (c) our legitimate interests, such as operating, securing, and improving the Site and Service and communicating with you, provided those interests are not overridden by your rights; and (d) compliance with our legal obligations.

We implement reasonable administrative and technical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction, including encryption of data in transit, access controls, and other industry-standard measures appropriate to the sensitivity of the information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. By using our Site or Service, you acknowledge that you understand and accept these risks.

We retain Personal Information for as long as necessary to provide the Site and Service, comply with our legal obligations, resolve disputes, and enforce our agreements, after which it is deleted or de-identified. Customer Data is generally retained for the duration of the applicable Account’s subscription and for a limited period thereafter to allow for export, unless a shorter or longer period is required or permitted by law or agreed with the applicable Customer.

You have the right at any time to ask us not to contact you for marketing purposes. You can do this by emailing us at support@workyla.com or using the unsubscribe link in our marketing emails. Notwithstanding a marketing opt-out, we may continue to send you communications reasonably necessary to respond to an inquiry you have made, service your Account, or fulfill the Service you have requested.

Most browsers allow you to control cookies through their settings, including blocking or deleting them. You can also opt out of Google Analytics tracking using Google’s opt-out tools, available at tools.google.com/dlpage/gaoptout. Please note that disabling cookies may affect the functionality of the Site and Service.

EEA/UK Residents

If you are located in the European Economic Area or United Kingdom, subject to certain exceptions and conditions under applicable law, you have the right to: request access to and a copy of your Personal Information; request correction or deletion of your Personal Information; object to or restrict certain processing of your Personal Information; request portability of your Personal Information; and withdraw consent where processing is based on consent. California Residents

If you are a California resident, subject to certain exceptions and conditions under the California Consumer Privacy Act (as amended), you have the right to: know what Personal Information we have collected, used, disclosed, and (if applicable) sold about you; request deletion of your Personal Information; request correction of inaccurate Personal Information; and not be discriminated against for exercising these rights. We do not sell or share (as those terms are defined under California law) Personal Information for cross-context behavioral advertising, and we have not done so in the preceding 12 months. The Site and Service may contain links to third-party websites and services, including Integrations you choose to enable. We are not responsible for the privacy practices employed by those third parties or the content they contain. This Privacy Policy applies solely to information collected by us through the Site and Service. We encourage you to read the privacy policies of any third-party websites or services you visit or connect.

Company reserves the right to change this Privacy Policy at any time. We will notify you of significant changes by placing a prominent notice on the Site or by emailing you if we have your email address on file. Significant changes will take effect 30 days after such notification. Non-material changes or clarifications will take effect immediately. We encourage you to periodically review this page for updates.
